Powers of Attorney
I guess it's time to talk about Powers of Attorney. You know, Wills and Trusts take care of our property when we pass on, but who takes care of us when we're sick and we can't make our own decisions? Once again, the state has written Powers of Attorney for us. It's going to be a spouse or our parents or our children who make the decisions. I think it's much better if you write your own directions if that's not what you want. If there are family squabbles about who can take care of your affairs, or if your disabilities are severe, families may apply to the court and ask to be your legal guardian. Of course, the first thing that a judge wants to know is this: did you nominate someone to be your guardian inside the document called your Power of Attorney? If yes, then the court tries very hard to accommodate that request. Well, if you didn't write a Power of Attorney, then we have to proceed to discover who is the best choice, and the court will appoint someone to make that discovery.
Don't forget, Powers of Attorney are just as important as your Last Will. They tell us who can take care of you during your life when you're not able.
